A group of miners are claiming that the compensation they received from the government for industrial injuries has been inadequate. Leeds county court is due to review the claims of around 20 miners against the law firms who originally advised them on their cases.
Each of the men involved are suffering from the condition commonly referred to as, ‘vibration white finger,’ which causes pain and sometimes even numbness. They are seeking compensation in order to claim for the tasks they need to employ people to do for them such as DIY and gardening maintenance.
In response the government have claimed that the scheme was administered fairly and that the miners were treated properly. However if the miners are successful in their claims they could make way for an estimated 50,000 other like for like cases.
The original law firms employed by the miners ensured that the men claimed under the government scheme which meant that they were not required to go to court before.
Some claims reached up to twenty five thousand pounds annually although others were just for a couple of thousand pounds per year.
The original scheme set up by the government was there to help people suffering from lung disease as well as vibration white finger. The scheme has now seen around 4.1 billion pounds already.
The main issue of concern was that they were given incorrect or misleading information by their lawyers when they placed their original claims. Some cases have been settled privately but some law firms have refused to settle.
Recently there has been much interest over the controversy surrounding the government compensation scheme and some solicitors have been accused of deducting client fees when they were actually receiving costs from the scheme already.
